Document Checklist

Family Petition (I-130) Document Checklist

Source-backed checklist for Form I-130 family petitions, including petitioner status proof, beneficiary identity records, relationship evidence, spouse I-130A checks, translation records, and current USCIS filing instructions.

An I-130 checklist should organize petitioner status proof, beneficiary identity records, relationship evidence, current Form I-130 instructions, Form I-130A when required for a spouse beneficiary, civil translations, and later financial support records for the immigrant visa or adjustment stage.

Petitioner status and filing route

Confirm whether the petitioner is a U.S. citizen or lawful permanent resident, then check current online or paper Form I-130 instructions and fee sources before filing.

Relationship evidence

Match the evidence to the family category, such as spouse, parent, child, or sibling, and include civil records, translations, prior marriage terminations, and bona fide marriage proof when relevant.

Spouse and support records

For spouse cases, review I-130A requirements. Keep I-864 support records ready for the immigrant visa or adjustment stage rather than treating them as the first petition filing packet.

Official Sources To Check Before Filing

Use these official pages to verify current form rules, filing posture, fees, processing-time data, and category limits. This page is a planning aid, not a filing decision.

  • USCIS Form I-130, Petition for Alien Relative

Check the current form edition, filing options, relationship evidence, and filing location.

  • USCIS Form I-130A, Supplemental Information for Spouse Beneficiary

Use when the petition involves a spouse beneficiary and current instructions require the supplement.

  • USCIS Green Card for Immediate Relatives of U.S. Citizen

Review how immediate-relative family petitions connect to the permanent residence process.

  • USCIS G-1055 Fee Schedule

Confirm the filing fee, filing category, and fee exemption or fee waiver posture before filing.

Petitioner Documents

  • Completed Form I-130, Petition for Alien Relative

Use the most current version from uscis.gov

  • Proof of U.S. citizenship or lawful permanent resident status

Birth certificate, naturalization certificate, or valid U.S. passport

  • Passport-style photographs only if current USCIS instructions require them for your filing situation

Photo requirements can differ by filing route and form instructions, so check current USCIS guidance before filing

Petitioner Documents (continued)

  • Copy of valid government-issued photo ID
  • Evidence of legal name change (if applicable)

Marriage certificate, court order, or adoption decree

Beneficiary Documents

  • Birth certificate of the beneficiary

Must be translated if not in English by a certified translator

  • Copy of beneficiary's valid passport (biographical page)
  • Passport-style photographs of the beneficiary only if current USCIS instructions require them

Relationship Evidence

  • Marriage certificate (for spouse petitions)

Civil marriage certificate required even if you had a religious ceremony

  • Proof of termination of prior marriages (divorce decrees, death certificates)
  • Birth certificates showing parent-child relationship (for children)
  • Photos of petitioner and beneficiary together
  • Communication evidence (call logs, messages, emails)

Financial Documents

  • Form I-864, Affidavit of Support

Required when the beneficiary is ready for immigrant visa or adjustment

  • Federal tax returns for the last 3 years

    Include all schedules and W-2s

  • Current employment letter or verification
  • Recent bank statements (last 3 months)
USCIS fee source: Check Form G-1055 or the USCIS fee calculator before filing Form I-130, including any online filing discount or paper filing difference.
